1. Acceptance of Terms
By accessing and using PrismFit ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
PrismFit is a SaaS platform that provides AI-powered fitness coaching tools, client management systems, and business automation for personal trainers, gym owners, and fitness franchises. The Service includes web applications, mobile applications, and related software services.
3. Account Terms
You must be 18 years or older to use this Service. You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account and password. You are responsible for all activities that occur under your account.
4. Payment and Subscription
Some aspects of the Service are provided for a fee. All new subscriptions include a 14-day free trial. You will be charged in advance on a recurring basis (monthly or annually) after the trial period ends. We offer a 30-day money-back guarantee for first-time subscribers. Annual subscriptions are eligible for pro-rated refunds for unused months after the initial 30 days. For complete refund terms and conditions, please refer to our Refund Policy.
5. User Content
You retain all rights to the content you upload to PrismFit. By uploading content, you grant us a license to use, modify, and display that content as necessary to provide the Service. You are responsible for ensuring you have the rights to any content you upload.
6. Prohibited Uses
You may not use PrismFit to: violate any laws or regulations; infringe on intellectual property rights; transmit malicious code; collect personal information without consent; interfere with the Service's operation; or engage in any activity that harms PrismFit or its users.
7. Privacy
Your use of PrismFit is also governed by our Privacy Notice. Please review our Privacy Notice, which also governs the Site and informs users of our data collection practices.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
9. Disclaimer
PrismFit is provided "as is" without any warranties, expressed or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any fitness or health outcomes resulting from use of the Service.
10. Limitation of Liability
In no event shall PrismFit, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect.
